Terms of Service

The Client must read and agree to the Terms below prior to ordering a commission. By sending payment, the Client agrees to the Terms. A breach of the Terms will result in cancellation of the Client’s current orders, a ban from doing further business with the Artist, and legal action where applicable.These Terms of Service are subject to revisions, editing, and additions without notice. The Terms in force at the time you order will govern your purchase. Before your next purchase, the Artist may have changed the Terms without notice to you. Please review the Terms each time you order.Updated April 2023



General

  • By commissioning Shinerai (the Artist), the Client is paying for artistic labor only. The Client does not receive rights to reuse, publish, edit, or sell the artwork being created.

  • The artwork is guaranteed to be a one-of-a-kind, original creation by Shinerai, interpreted in Shinerai’s art style, not previously sold elsewhere.

  • By sending payment, the Client agrees to the Artist’s Terms of Service, attests that they are 18 years of age or older, and attests that they are using their own payment instrument and their own money.

  • The Artist reserves the right to reject any commission for any reason.

  • The Artist reserves the right to cancel any commission at any point for any reason.

  • The Artist currently does not accept “written description only” commissions; the Client must provide visual references of the character(s) to be depicted.

  • The Client must be the owner of the character(s) to be depicted or have permission from the owner to have their character(s) depicted. The Artist may accept commission requests intended to be surprise gifts, but the Artist will tag the owner of the character on the social media post. This rule has been implemented to thwart character theft.

  • Commission material is subject to the Artist’s approval. Shinerai prefers to produce SFW work and will not accept any requests to depict the following:

  • Hate/discrimination

  • Genitalia or any sexual acts

  • Excessive violence/gore


Payment and Refunds

  • Ko-fi commission payments are collected via the Ko-fi platform. Commissions accepted via the Commissions Inquiry Form are done via PayPal invoice sent from the Artist to the Client.

  • All prices and PayPal invoices are in USD.

  • Full payment of PayPal invoices is expected within 72 hours of the invoice being sent. Payment plans are currently not available. If the invoice is unpaid after 2 weeks, the Artist will cancel the invoice and drop the Client’s request – the Client will not retain a position in the Artist’s to-do list and will need to re-order, subject to the Artist’s availability.

  • The Client will not send any unsolicited PayPal payment directly to the Artist. Any random payment sent to the Artist’s PayPal without permission will be refunded, minus any fees deducted by PayPal.

  • The Artist will not start working on the commission until full payment is received. The Artist might not start working on the commission immediately after payment is received.

  • The Client may request to cancel the commission:

  • If the Client requests to cancel the commission before the Artist has started working on it, the Client will be provided a full refund.

  • If the Client requests to cancel the commission while it is in progress, the Client will receive a partial refund in an amount determined by the Artist based on how much time has already been put into the commission.

  • The Client is not eligible for a refund if the commission is completed.


Edits

  • Minor changes can be requested at any time prior to the completion of the commission without charge.

  • For commission types with an approval stage, the Client may request 2 revisions (changing the pose, palette, background, etc.) during the sketch phase for free. Further major changes (revisions) will incur a fee. Once the sketch has been approved, only minor changes are possible.

  • Whether a commission type has an approval stage will be specified on the Commission Info page.

  • The Artist will fix mistakes at any point for free if the requested changes are clearly noted design elements that were missed at fault of the artist.

  • The Client is responsible for providing all relevant information and up-to-date, clear references at the time the commission is being ordered. The Artist is not at fault for any mistakes made due to the provided reference(s) being out-of-date, unclear, missing details, or if relevant information was not provided. Fixing these mistakes will incur an additional fee.


Communication, Deadlines, and Delivery

  • The Artist can be contacted via private message on DeviantART, Twitter, Instagram, or Ko-fi, or via email at [email protected]. During the ordering process, the Client and Artist will agree upon a preferred communication platform.

  • Deadlines, if not explicitly stated in the commission offering, must be requested, and agreed upon prior to payment. The Artist reserves the right to decline deadlines mentioned after the commission has been paid for.

  • The turnaround time for commissions is not yet measured but expected to be 1 to 2 months on average. The Artist may finish the commission faster or slower depending on the commission type, technical problems, long queue, vacation, etc.

  • The Artist will update the Client on the progress of their commission, and seek approval whenever relevant, by sending low resolution work-in-progress (WIP) images of the artwork in its current phase of production. The updates/WIPs will also be uploaded to the public Trello for tracking purposes.

  • The Client may request WIPs at any time with a reasonable cadence (please not daily) and with the understanding that there may have been no progress since the previous WIP, especially if there is not an agreed-upon deadline.

  • Completed artwork will be uploaded to the Artists OneDrive and a link to the OneDrive file(s) will be sent to the Client via the preferred communication platform. The OneDrive file will be accessible to the Client for 1 month.

  • A smaller version of the completed artwork will be posted on the Artist’s personal social media pages.

  • Unless otherwise specified in the commission offering, the completed artwork will be a digital illustration and a physical copy will not be shipped to the Client. The Artist does not provide a PSD (or PSS or other layered file type) or unwatermarked version of the completed artwork to the Client.


Image Rights

  • The Artist retains all copyrights on the artwork, including but not limited to: the right to display, distribute, reproduce, or use the artwork as a sample for sales and self-promotion. The Artist reserves the right to display the artwork on any of their personal galleries or portfolios.

  • The Client retains all rights to their IP and grants the Artist temporary license to use their IP for creation of the commission.

  • The Client may request that the Artist not distribute/reproduce the finished artwork (e.g. sell as prints) but this must be agreed upon prior to invoicing and will incur a 10% fee. This exception does not apply to Ko-fi commissions, which are premade slots at a fixed price.

  • The Artist reserves all rights to declined/cancelled sketches, designs, and projects and may modify, repurpose, or resell them.

  • The Client may not use, edit, repost, finish, or have someone finish, any WIP images or designs they may have received for commissions completed or cancelled.

  • The Client may not use, edit, repost, finish, or have someone finish, declined sketches, designs, and WIPs.

  • The Client may not use the finished artwork or sketches/WIPs for NFTs or crypto-related projects.

  • The Client may use the finished artwork for non-commercial and personal use only.

  • The Client may share, upload, repost, and display the smaller version of the finished artwork on their personal social media. Crediting the Artist via link back to the Artist’s Carrd or tag to the Artist’s relevant social media account is appreciated.

  • The client may only use the full-size version of the finished artwork (if provided by the Artist) privately and may not post or publish the file anywhere. The Client may print the finished artwork for personal use, not for distribution or resale.

  • The Client may crop, rotate, and resize the finished artwork to fit a personal icon, banner, sig, or page decoration.

  • The Client may not heavily alter, recolor, change, or otherwise deface the artwork.
